These Terms of Service ("Terms") govern your access to and use of Muvex.ai and the website at muvex.ai, together with all related applications, features, and services (collectively, the "Service"), operated by Muvex.ai ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. By using the Service you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.
Muvex.ai provides tools that use artificial intelligence to help you generate, edit, and produce media such as images, audio, and video, and to publish that content to third-party platforms you choose to connect. The Service may change, and we may add, modify, or remove features at any time without notice.
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We are not liable for any loss or damage arising from your failure to protect your account.
Certain features require a paid plan or the purchase of credits. Prices, credit costs, and plan features are described at the point of purchase and may change. Except where required by law, payments and purchased credits are non-refundable. You are responsible for all applicable taxes.
"User Content" means any input, prompt, file, or material you upload to, or generate with, the Service. As between you and us, you retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and transmit your User Content solely to operate and provide the Service to you, including transmitting it to the AI providers and third-party platforms needed to fulfill your requests.
You are solely responsible for your User Content and for the consequences of creating, storing, or publishing it. You represent and warrant that you own or have all rights necessary to your User Content and that it does not infringe or violate the rights of any third party or any law.
The Service uses automated and AI systems. Output may be inaccurate, incomplete, offensive, or unintentionally similar to existing material, and the same or similar output may be generated for other users. You are responsible for reviewing, editing, and verifying any output before relying on or publishing it. We make no representation that output is accurate, original, or fit for any particular purpose, and we are not responsible for any decisions you make or actions you take based on output.
The Service lets you connect third-party accounts (for example, YouTube/Google and TikTok) and publish content to them. When you connect an account, you authorize us to access and use that account only to perform the actions you request, subject to that platform's own terms and policies.
Your use of any third-party platform is governed solely by that platform's terms and privacy policy. You are responsible for complying with them and for any content you publish through them. We do not control third-party platforms and are not responsible for their availability, decisions, policies, content moderation, account actions (including suspension or removal), or any loss arising from your use of them. Connecting or publishing through the Service does not make us a party to your relationship with any third-party platform.
You agree not to use the Service to: (a) violate any law or third-party right, including intellectual property, privacy, or publicity rights; (b) create or distribute content that is unlawful, defamatory, harassing, hateful, sexually exploitative (especially involving minors), or that promotes violence; (c) impersonate any person or misrepresent your affiliation; (d) upload malware or attempt to gain unauthorized access to the Service or its systems; (e) reverse engineer, scrape, or overload the Service; or (f) use the Service to generate misleading, deceptive, or fraudulent material. We may suspend or terminate access for any violation.
The Service, including its software, design, text, and trademarks (excluding User Content), is owned by us or our licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. No other rights are granted.
THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT WILL BE SUCCESSFULLY PUBLISHED TO OR RETAINED BY ANY THIRD-PARTY PLATFORM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL MUVEX.AI, ITS OWNERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, ANY OUTPUT, OR ANY THIRD-PARTY PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100.
You agree to defend, indemnify, and hold harmless Muvex.ai and its owners, employees, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Service, your publishing to any third-party platform, or your violation of these Terms or any law or third-party right.
You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, including for violation of these Terms. Upon termination, the rights granted to you will cease; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
We may update these Terms from time to time. The "Last updated" date reflects the latest version. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the competent courts located there for any dispute that is not subject to mandatory consumer-protection rules in your country of residence.
